Old Man And The Sea - A Modern Day Story

By Richard Young The paddle from our launching site at Yokohama Bay to Kaena Point, where we usually turn around and start the return leg, is about two hours. On this day the waters were calm, the sun was hot, and the fish werent biting in the least. It was the kind of day that one gets lulled to the brink of sleep due to a complete lack of activity combined with the kayaks gentle roll from side to side with each stroke of the paddle. Turning around after hours of paddling and realizing our trip was halfway done with nothing to show was disappointing. The breathtaking view of the shoreline, a rocky coast transitioning quickly to the sheer mountain range separating the islands southwest and northern shores, didnt seem to provide consolation for what was looking more and more to be a “skunk” day. As we turned our kayaks around to start heading back, I reeled in the mackerel I had been dragging just to check if it was intact. Sure enough the mackerel was still there, without even a bit of evidence that something had tried to get it. I went ahead and replaced the bait with a fresh one for no other reason than to give myself something to do. The night before, I had taken my entire reel apart to clean and grease it so as to be ready for any action wed experience that day. Perhaps it was this extra preparation and my resulting heightened state of readiness that made the lack of any action so hard to bear. Or maybe it was that this was the first really hot day out on the water having no cloud cover at all. Picking up the pace of my paddling, I tried to get out of the shallower water that surrounded this westernmost tip of Oahu. It’s always irritating to have one’s bait shredded by the smaller reef fish that were large enough to bite the bait but too small to take the hook. Suddenly, my reel screamed as it emptied line faster than I had ever experienced! I tried but was unable to lift the rod out of its holder as the fish’s unrelenting run created strong pressure on the rod literally freezing it in the holder. As I tried to tighten up on the drag, I realized my spool was about two-thirds empty and line was still going out! In a bit of a panic, I tried to crank the reel while still in the holder then felt my heart sink as the crank handle spun free! In disbelief of the situation, I continued cranking the handle, yet it would only freewheel as if a gear had broken. Suddenly, before I could figure what had gone wrong, the whole spool flew off its axle and jumped around madly as line continued to fly out through the rod as it remained stuck in its holder. The fish stopped its run, seemingly to give both of us a breather, which gave me a chance to dismount the rod and grab the line directly. Knowing that the thirty-pound test line could easily sever my fingers, I removed my hat and used it as a glove while applying line pressure on the running fish. Thankfully, the kayak was now being pulled by the fish and added to the resistance to slow its run. As the fish pulled the kayak along at a pretty decent clip, I was able to simply hold on to the line and contemplate the situation I was in. Apparently, I must have left a screw loose when reassembling the reel housing leaving the gear assembly to come out of place. Of all days to get the strike of a lifetime! As I held on to the line, wondering what was on the other end, I started laughing. I could only think of Spencer Tracy in The Old Man And The Sea. I laughed out loud as I realized here I was in the dawning of my senior years, living out scenes from one of my all time favorite movies. After about a half hour of line give-and-take, I finally could see what turned out to be the biggest barracuda Ive ever seen in my life. It measured around five feet and, when brought alongside, continued to propel the kayak as I looked on in awe. My partner who had been laughing non-stop throughout the event paddled over and asked what I was going to do with it. I replied, “this ones going back to fight another day!” We took a picture as I held my trophy as high out of the water as I could then released it to the depths from which it came. As the adrenalin wore off I realized, looking at the tangled mess of line in my lap, I had no tackle to fish with for the long paddle back! Half-heartedly, I tied a long length of line with a baited hook to my bowline and threw it over the side. Although the chances were slim that something would bite, the effort would at least give me something to anticipate during the long paddle back to our starting point! Paddling even slower, I again began to get lulled into sleepiness as I day-dreamingly watched my bowline dragging in the water alongside the kayak. And then, this time very quietly, I noticed the bowline being pulled away from the kayak like the minute hand of a clock moving from the six toward the twelve. “Ohhh my God,” I muttered to myself before yelling to my partner who looked over to me just as the bow line went tight then cracked like a cap gun! The fish had broken the line. Suddenly, my partner yelled out my name as he laughed and pointed out a large mahi-mahi (dorado) jumping madly in the distance apparently trying to shake the hook that it’s taken along with my broken line. Convinced now that anything was possible, I knew I could land a decent-sized fish if I could only allow it to take line until the kayak began moving. I then picked up the spool and snipped off the mess of tangled line. Then, with a quarter of the original line remaining in the spool, I placed it back onto the axle and set out another baited hook. Within a half hour, I got another strike. This time, I was ready! I grabbed my hat off my head and again using it as a glove held the line in one hand while my other hand held the spool as to prevent it from over-spinning. The pressure was enough to check the fishs initial run and soon I was again in an exchange of getting and giving line, this time with another mahi-mahi! The exchange went on for about a half hour and finally ended with the successful boating of a seventeen-pounder and what will probably be the biggest fish story of my life. And like The Old Man And The Sea, I returned home tired yet victorious… then crawled into bed to take a nap. How To Borrow Rollover IRA Money?

You can do a rollover when you are leaving your job for another one, opening yourself a small business or retiring. Several benefits exist if you do a borrow rollover IRA and it gives you more control of how your funds are utilized, not to mention where they are invested amongst other things. This is because if your retirement funds are invested in the company plan you you dont have an option of deciding where to invest or have a limited option. If you convert to a Roth IRA it gives you the benefit of a tax free withdrawal after a five year holding period. At that same time you can avoid the Spouse Consent Rule. This rule forces you to take consent of your spouse if you decide to name any one else the beneficiary of the account. Although to take advantage of this you must be single. Which means simply, doing a borrow rollover after you have married will not give you this flexibility but if you rollover while you are still single you can make use of this. Furthermore, when you have company stock accumulated in your account and it has appreciated in value then it makes more sense to withdraw that stock and hold it in a taxable account than to do a borrow rollover IRA. This is because the tax that will be charged will be on the value of the shares when they were given to you and if the stock has appreciated then that amount will be considerably small. However, there’s a catch here which can be easily avoided. If you ask your employer for the IRA money, they might make the check in your name. This could well mean that you will have to pay 20% tax on the amount and if you are under 55 an extra 10% as withdrawal penalty. To ensure that you are not taxed doing a borrow rollover IRA money, make sure that you arrange for a direct rollover, which is done when the check from your previous employer is made in the name of the new custodian or trustee of the IRA plan and not in your name. You will have to then notify the administrators of your old IRA who will have paperwork for you to do. You will receive a cheque which you must deposit within 60 days to avoid paying the withholding tax. Moreover, you can only roll over to your account what you hold in your previous one. Meaning, if you have cash then you can only roll over cash. You dont have the option of using cash to buy stock and then deposit that in your next IRA account. Borrowing Your IRA account can also be used as a vehicle for short term borrowing. If you need short term cash you can withdraw money from your IRA account without interest charges, loan processing or any other paperwork. The processing is quite effortless. The couple of things to keep in mind are that you have to repay this sum within sixty days. After taking a loan you have to replace the entire amount within 60 days in either that same account or a new account to avoid paying the IRA tax withdrawal which is 10% of the amount. Keep in mind that you can only make one such withdrawal each year. All these new fangled phone head sets make people look like a crazy babbler or an alien with wires protruding out of their heads and my friend Ronnie’s no exception. Seeing him saunter into the coffee shop I expected to hear dialogue about some new real estate deal booming from his mouth instead I heard the phrase, “You can hear me. I mean you can really hear me?” The surprise radiating from his face was reassuring considering the countless commercials I’ve seen with people in deserted fields in the middle of nowhere shouting into a cell phone, “Can you hear me, can you hear me” the invariable yes occurs on the commercial, but in reality the call is dropped and no one is heard. The hands free headsets only complicate the perceived loss of hearing if you ask me. Of course when they do their job right headsets are a blessing freeing one’s hands to do other needed tasks. Finishing the last of my Chai Latte I watched Ronnie talk to his caller and continue to express the joy of being heard. I mean it’s what we all want in life, right? Someone who hears us; I mean really listens. Maybe Ronnie has found a little part of the secret to life. I ordered another Chai Latte and a Chitico (Rich Hot Chocolate) for Ronnie. Cleaning up the stack of newspapers at my table by the fireplace I motioned for him to join me, which he did with this Cheshire grin on his face as he wrapped things up with the caller. Ronnie relayed the woes of using various head sets. He mentioned how one headset, which came with his old cell phone didn’t work at all, how another one did, but developed a strange whistle sound, which he never heard, but his callers did. They found it so annoying some took to calling him Whistling Ronnie, which he wasn’t too happy about. The admission of this incident sent me laughing hysterically and spewing coffee on the table. When I cleaned up the spilled Chai Latte I heard all about the headset Ronnie referred to as the “Heavy Breather”. Using that one callers heard his breathing or what sounded like breathing, which could just as likely have been caused by static from a poor connection. Letting Go of “Meantime” Relationships

By Talayah Stovall Weve all been there. Weve spent time with someone who we knew was temporary until the right one comes along. Sometimes, we even fool ourselves into thinking that that someone is the right one. We have all tried to shave the edges off some square pegs in order to fit them into round holes. There is something about Mr. In the Meantime that keeps you engaged in the relationship. It might be his kindness, his looks, his personality or his bank account (or, it might be just our own desire not to be alone). But, there is also something about him that you know is a deal breaker. While it is sometimes very difficult to let go of a relationship, we should never hold on to a relationship just to be in one. Meantime relationships help pass the time while you are still searching. Unfortunately, while you are spending valuable time with someone who clearly lacks the qualities you desire, just to have someone with whom to spend time, you might be unavailable or unaware when Mr. Right knocks on the door. Meantime relationships are often merely filling in the emotional, and sometimes physical, gaps that are present when we seek the temporary elimination of feelings of loneliness. Sometimes we use Mr. In the Meantime to help us recover from a relationship whose ending was either abrupt or particularly painful. A girlfriend of mine once remarked, The best way to get over one man is another man. This thinking perpetuates into rebound relationships that are often more painful when they end and they will end than the one from which you are trying to heal. Whenever we say goodbye to someone we love, even when we know that that person is not right for us, it hurts. We can save ourselves much heartache by recognizing and acknowledging from the beginning, that the Meantime man is not right for us, instead of trying to force a relationship. And, once we recognize and acknowledge that, we can free ourselves for a deeper love and commitment with the one who is our destiny. Choosing a mate is a serious decision which will impact the rest of your life. It is a decision that can make or break you. Dont be swayed by charm and style that have the appearance of authenticity, and dont settle for second best; it is not worth it in the long run. Solid relationships are built on friendship, honesty and sincerity. Proverbs 7:5 warns us to Beware of the stranger who flatters with words. Some people will tell you what you want to hear, but their actions will reveal that they are totally insincere. It is so important to watch and listen. If he looks like a duck, but acts and sounds like a dog, he is either pretending to be something other than what he appears, or he is confused. Women, especially, often allow feelings to overrule logic and common sense. That said, our intuition rarely leads us astray. If we are picking up a vibe that something is not right, usually something is not right. Pay attention to the signals and let him go. Do not hold on to hope when all the signs indicate that you should cut your losses. The Bible reminds us that we will know a tree by the fruit it bears. What You May Not Know About House Churches

By Michael Tummillo As many of you are aware, I am a strong advocate of The Church, the ‘ekklesia.’ Though many have heard that word, surprisingly few are aware that it is NOT a religious term. Actually, it is a Greek word that means “the called out ones.” It referred to a forum of Roman men - a council - that the Roman Empire would send into any region that its armies had conquered so that they could teach their captives to become Roman citizens. Get that? Rather than crush their defeated foes, wipe them out, they allowed them to remain as farmers, blacksmiths, shopkeepers, etc. so that they could collect their taxes and assimilate them into Rome’s culture. Again, Rome’s goal was to make them Roman Citizens. The early Christians related to the Roman concept of ekklesia and saw the similarity of their mission. So, they adopted the term for themselves. The concept was short-lived, unfortunately, as the Empire struck back! Constantine declared Christianity the state religion and, at that moment, the ekklesia lost its impact. Through the generations, any time any group has attempted to return to New Testament Christianity and revive the ekklesia, they were ostracized, persecuted and murdered by the thousands - even by others who called themselves ‘Christians.’ Philemon 2 …and to the church that meets in your house; Colossians 4 …and the church in her house; Romans 16 …also the church that meets at their house…although we read these verses and others, sometimes wondering what that style of Church-life was like, we forget that, throughout the planet to this day, Christians STILL gather in homes. Likewise we forget that, even today, many of these brothers and sisters still face persecution and even death. What do we mean by ‘House Church?’ Some call them simple churches. Others use the term ‘organic churches’. The Bible refers to them simply as “the Church.” By definition, they are rapidly multiplying, simple communities of believers, meeting in homes, offices, campuses…wherever God is moving. This is the pattern common to many parts of the globe, and is now becoming more and more common in the U.S. as well. Where are two or more are gathered in His name, there is Church. The House2House website says, “Where “DNA” is present among people, there is church. “D” stands for Divine Truth (loving God/Jesus) “N” stands for Nurturing Relationships (loving one another deeply) “A” stands for Apostolic Mission (being on Jesus’ mission to the world)” Buildings, programs, titles and professional clergy are NOT essential elements of a church. Never have been. That happened when the ekklesia attempted to get organized and even began blending itself with pagan religions. Let’s bear in mind that Constantine took the title Pontificus Maximus (highest priest, forgetting that Jesus Himself is High priest) and was head of ALL things spiritual, Christian and pagan. He did what anybody would do, choosing the path of least resistance and merging the two extremes the best he could. Do you see what happened to the early Church? She became absorbed in the ways of the world. The House2House site continues: “By ’simple church’, we mean a way of doing and being church that is so simple that any believer would respond by saying, “I could do that!” “By ‘house church’, we mean the kind of church that is described in the New Testament. Not constrained by structure but by the needs of the extended family of God, and driven by a desire to extend the Kingdom of God.” This style of Church can more easily listen to God and mobilize, led by His Spirit and obeying His commands. One day a gathering can be a healing center. Another time, a teaching center. Another time a worship center. Another time, a fellowship hall. Another time, a prayer meeting. We can mix and match and we can spontaneously load up the cars and head out to minister to others as well (my first gathering was a dinner where a woman called threatening to kill herself. We left our meal and sped over there. She’s doing fine these days.) We’re describing a family who shares the same Father; not a heavenly being inthe clouds but One who dwells within and works through us. We have a greater opportunity to become spiritual parents raising spiritual sons and daughters to establish their own families in their own realm of influence. Church as unusual This kind of church may or may not meet in a house. It can meet anywhere we are because we ARE the Church. Statistics reveal that people are leaving traditional church to find God. Traditional churches are shrinking while house churches are growing. Personally, I have met with groups in coffee shops, hair salons, bank conference rooms, bed and breakfasts, a spare room over a noisy bar, hotels and nursing homes. Church Planting Movements (apostling) occur when simple churches multiply rapidly. And they DO multiply rapidly. Why? because unlike traditional churches, individuals gathering in homes are free to explain the concept at their friends’ homes or offices, attracting an entirely NEW group of people instantly within that sphere of influence. If the individual has an opportunity but is a novice, no problem! More experienced people are always available to assist. It’s NOT rocket science, as you can tell. The spiritual climate is RIPE for this outreach today. People are SO receptive to this concept of Church and becoming more so all the time. Does this style of Church lower the quality of disciples? Absolutely not! While no structure or format can guarantee quality, we believe that the small, participatory, family-like environment of a simple church is ideally suited to the goal of helping people become passionate disciples of Jesus Christ. The proof is in the pudding and there are multitudes of testimonies to back that claim. As you see, this is not really a new concept but a very old “new” idea. Two more examples from Scripture include: “Greet Priscilla & Aquila, my fellow workers in Christ Jesus. They risked their lives for me. Not only I but all the churches of the Gentiles are grateful for them. Greet also the church that meets at their house.” Romans 16:3-4 “But when the Jews opposed Paul and became abusive, he shook out his clothes in protest and said to them, ‘Your blood be on your own heads! I am clear of my responsibility. From now on I will go to the Gentiles.’ Then Paul left the synagogue and went next door to the house of Titius Justus, a worshiper of God.” Acts 18:6-7 Acts 16 shows us examples of others. Does this ‘movement’ hurt the local Church? If by that we mean do House Churches strengthen the Body of Christ in our nation, the answer is a resounding YES! This IS the local Church! Those affiliated are being taught that the traditional Church is NOT the enemy. They are our relatives in Christ. Fact is, of those 22 Million who say they attend home groups, only 3 Million do so exclusively. The balance claim to be Members of traditional denominations (whether they actually participate or are content to have their name on the role is another matter). When statistics reveal that “church as we know it” is shrinking in America and house church affiliates are increasing by around 4% annually, personally, I see it as a move of God. My recommendation? Do You Know The History of the Bible?

By Steven Coffman This is a brief history of the evolution of Bible and some of its various translations. The Christian Bible has the honor of being the first book every published in volume, and the most published book in history to this date. It has been written in almost every spoken language in the world today. Like many ancient works, the oldest parts of the Bible were passed along orally before they were ever written down. Many devout Jewish people today believe that the full text of what Christians call "The Old Testament" Bible was given to Moses by God on Mount Sinai. The Bible’s earliest origin may always be a matter of faith, but it still remains a fact that after the Bible was first recorded, many different versions existed in several different languages. It was not until the first century B.C.E. (Before the Common Era, aka B.C.) that Jews settled on the canon of their scripture. The oldest written parts of the Bible found were transcribed in three languages. What scholars call the Hebrew Bible (the same books Jews call the Tanakh or Written Torah, and Christians call the Old Testament) was first written in Hebrew with a few chapters of the books of Ezra and Daniel recorded in Aramaic. Hebrew had long been the language of the Jewish people, so their scriptures were passed down in Hebrew. Some of the books of the Hebrew Bible may have been written as far back as 1,400 B.C, although most of the text was probably written between 900 and 400 B.C. Aramaic is a Semitic language that was widely spoken from 600 to 200 B.C. in the near Middle East. It was one of the common languages of the region until the 13th century, when Arabic became more prominent. Many people today believe Jesus and his apostles spoke Aramaic. Aramaic was the spoken language in Mel Gibson’s movie "The Passion of the Christ" that was subtitled in many languages. The Christian New Testament was written in the common Greek of the Mediterranean area and parts of the Middle East at the time in the first century C.E. (Common Era, aka A.D.). This form of Greek is called Koine Greek. It developed from classical Greek, and spread by the conquests of Alexander the Great. As different people began to use the tongue, it evolved and changed into Koine Greek between 300 B.C. and 300 A.D. This form many scholars think may have been the second language of Jesus and his apostles — after all, the gospels of the New Testament portray that Jesus spoke with Pontius Pilate, who would have been more likely to understand Greek than Aramaic. The Books that one day became the New Testament was probably written mostly in Greek because it was the common language around the Mediterranean at the time of its inception. In 312 A.D. right before a major battle, the Roman Emperor Constantine the Great said that "Jesus appeared to him in a dream, giving him a sign that he will be victorious." He won the battle and Constantine looked upon Jesus as the deliverer of this victory. Constantine then ended the persecution of Christians by issuing the Edict of Milan in 313 A.D. In 325 A.D. Constantine the Great called the First Council of Nicaea, composed of 300 Christian and religious leaders of the time. The council was given the task of separating divinely inspired writings for those of questionable origin. The council then agreed on all the books of their New Testament, and also decided not to accept 15 books of the Greek translations of the Bible because they were not part of the original Hebrew Scriptures. The 15 books that were not accepted by the council became known as the Apocrypha. It was not until 1545 A.D. at the Council of Trent in Italy that consisted of 255 Christian Catholic leaders which relied heavily on the teachings of Thomas Aquinas, that the edit of The New Testament of the Bible was completed and then called Canon. After the Roman Empire itself became "Christianized" and Latin becomes the common language, the entire Bible was translated into Latin early in the 5th century. The first Latin version is called the Vulgate. It takes its name from the phrase versio vulgata, i.e., "the translation made public". The Vulgate was designed to be a definitive and officially promulgated translation of the Bible, improving upon several translations then in use. It was the first, and for many centuries the only, Christian Bible with an Old Testament translated directly from the Hebrew rather than from the Greek Septuagint. In the mid-15th century, when Johannes Gutenberg invented movable type, the Latin Vulgate edition of the Christian Bible was the first work he printed. On September 30, 1452, Johann Guttenberg’s Bible was published becoming the first book to be published in volume, of which about 180 were printed. The pages of the books were not bound, and the date 1455 is documented on the spine by the binder for a copy bound in Paris. In July of 1604 A.D. King James of England wrote to Bishop Bancroft that he had nominated 54 learned men (linguists and biblical scholars) to once again translate the Bible, (but only 47 actually took part) in what became know as The King James Version (KJV) and was published in 1611. Many Christian fundamentalists today feel that this version is on one and only true version of God’s Holy Word. Over the centuries it became increasingly difficult for some people to truly understand the (Old English) vernacular. Hence, a new translation was first made called The New King James Version (NKJV) that had 130 translators in this edition. The New American Standard Bible (NASB) was translated in 1971 by 58 scholars. The NASB has sought to render grammar and terminology in contemporary English. Special attention has been given to the rendering of verb tenses to give the English reader a rendering as close as possible to the sense of the original Greek and Hebrew texts. In 1995, the text of the NASB was updated for greater understanding and smoother reading. Christians today continue to yearn for a better understanding of the Word, and a closer relationship with God, came The New International Version (NIV). More than 100 scholars from six English-speaking countries, as well as editors and English stylists, worked on the (NIV). The scholars represented more than 20 denominations. It took 10 years to complete the (NIV) translation. The process started in 1968 and finished in 1978. This does not include more than 10 years of planning before 1968. It has since become one of the more popular editions. For me, the word "BIBLE" stands for; Basic Instructions before Leaving Earth. I truly feel that everyone should read a copy it and gain from the insight and benefit of its words. The headline has to be simple yet state with clarity that you are the perfect choice for the specific job or position. Clarity of objective requires that you be clear about your own career direction. By Michele Schermerhorn Recent studies concerning the new world of women have been released. Some of the major findings may be surprising to you (less so if you are a woman). Today’s woman is so busy, her life is full. She doesnt have enough time for herself. She certainly doesnt have a lot of time for your marketing message. So what do you need to do to reach her? Fact #1: Fifty-nine percent of women rarely or never read a newspaper from beginning to the end, compared to 41% of men. The traditional advertising through newspaper ads or inserts certainly wont help your marketing efforts if women are your targeted audience. However, they might read newsletters from child care establishments, yoga classes, or spas. If print advertising is a large portion of your advertising budget, think about getting a lot more targeted in the types of publications where you advertise. Fact #2: Only half (51%) frequently watch a television program from start to finish, compared to 60% of men. Just 47% frequently listen to the radio for more than 30 minutes straight versus 62% of their male counterparts. There go those television and radio spots too. The only exception regarding radio spots, are the number of working women who listen to the radio all day at their jobs. Check with your local radio stations and find that station preferred by those women in your area. Fact #3: Fifty-six percent of women surveyed rarely or never read a magazine from cover to cover, a percentage that, surprisingly, is nearly similar to their male counterparts (57%). Like newspaper advertising, consider choosing the magazines that are specifically targeted at women if you want to get your message across. Fact #4: Women (mid-20s to mid-50s) dont have a lot of time available to absorb the information. So offering shorter chunks of information for women to digest likely will cut through the clutter. Adding pictures that capture the essence of your message will also grab their attention. Fact #5: Women spend a significant amount of time thinking and caring for others. Marketers can tap into women by showing them how their products and services can help them take even better care of others, and themselves. Fact #6: Women enjoy being invited to do something; to attend a special luncheon in honor of a local celebrity or non-profit agency; to have a sneak preview of next month’s latest and greatest; to be given the chance to offer input into how you’re doing. Invite more women to your location with a promise of something in return (a small offering, a gift, a surprise?) and you will build traffic. Fact #7: According to Nielsen NetRatings, women now account for 52% of the 55 million Internet users at home (contrasted with 48% male). However, men spend 24% more time surfing the Internet than women. Therefore, you have to catch her and catch her fast. Research the sites like iVillage.com which are most frequented by women. Make certain your advertising has a gripping picture to capture their attention. Without grabbing their attention, theyll never read your clever advertising copy. In summary, women are busy people. Your product or service must make her life easier. And, you must go out of your way to position your message in front of her at places she is already visiting. Oh, and last but not least, dont fail to deliver on your advertising promise when she does buy from you. She has many, many alternatives to your company. The “What” And “Who” Of Domestic Violence

By Kayla Boucher The WHAT: Violence What exactly constitutes domestic violence against another person? Is physical contact required? Or are threatening words enough? Although the crux of domestic violence is defined similarly across state lines, many legislatures express subtle distinctions from one another in their definitions of this unlawful behavior. Therefore, a potential victim must research the law in the jurisdiction in which the abuse occurred. In California, the Family Code provides the most cohesive definition of domestic violence. The sections dealing with domestic violence are collectively known as the Domestic Violence Prevention Act (DVPA). Section 6203 of the DVPA uses the word “abuse” synonymously with the word violence. These two words can be defined as any of the following: (1) Intentionally or recklessly causing or attempting to cause bodily injury (2) Sexual assault (3) Placing a person in reasonable apprehension of imminent serious bodily injury to their person or the person of another. Many legal minds provide a more expansive definition of domestic violence, and even classify such behavior into different groups PHYSICAL ABUSE: Grabbing, pinching, shoving, slapping, hitting, hair pulling, biting, etc. Denying medical care or forcing alcohol and/or drug use. SEXUAL ABUSE: Coercing or attempting to coerce any sexual contact without consent, e.g., marital rape, forcing sex after physical beating, attacks on sexual parts of the body or treating another in a sexually demeaning manner. ECONOMIC ABUSE: Making or attempting to make a person financially dependent, e.g., maintaining total control over financial resources, withholding access to money, forbidding attendance at school or employment. EMOTIONAL ABUSE: Undermining a person’s sense of self-worth, e.g., constant criticism, belittling one’s abilities, name calling, damaging a partner’s relationship with the children. PSYCHOLOGICAL ABUSE: Causing fear by intimidation, threatening physical harm to self, partner or children, destruction of pets and property, mind games or forcing isolation from friends, family, school and/or work. The common thread here is clear: all domestic violence is a pattern of abusive behavior which keeps one partner in a position of power over another close person in their life through the use of fear, intimidation and control. THE WHO: Domestic Who can commit domestic violence against you? Can a victim only plead domestic violence against his or her spouse? His or her boyfriend? A live-in partner? In essence, a discussion of what types of relationships give rise to the potential for domestic violence has forced the California Legislature to determine exactly what they mean by the word domestic in the phrase domestic violence. Section 6211 of the DVPA states that “domestic violence” is abuse perpetrated against any of the following persons: (1) A spouse or former spouse (2) A cohabitant or former cohabitant (3) A person with whom the respondent is having or has had a dating or engagement relationship (4) A person with whom the respondent has had a child, where the presumption applies that the male parent is the father of the child of the female parent under the Uniform Parentage Act (5) A child of a party or a child who is the subject of an action under the Uniform Parentage Act, where the presumption applies that the male parent is the father of the child to be protected; (6) Any other person related by consanguinity or affinity within the second degree. (Family Code, Division 10, PREVENTION OF DOMESTIC VIOLENCE, Part 1., Sec. 6211). In lay terms, the following people can commit domestic violence against you in California: your spouse or former spouse. someone you live with or lived with in the past (but you must have a closer, more intimate relationship than just roommates) someone you are dating or have dated someone you have a child with someone to whom you are related by blood, marriage, or adoption (including your parent, grandparent, child, grandchild, brother, or sister) In addition, California law allows minors 12 years old or older to file for restraining orders without the assistance of a parent or guardian. Furthermore, same-sex partners are also eligible to file for restraining orders. The two most important buzzwords to think of in determining whether the violence against you is domestic are family and intimacy. The likelihood of violence being domestic when the perpetrator is either family or one you share intimacy with is extremely high. In order to obtain legal relief, a victim must sufficiently inform the court of both the WHAT and the WHO in domestic violence.
